Kielce, 13 May 1948, 11.00 a. m. Stefan Młodawski from the Criminal Investigation Section of the Citizens’ Militia Station in Kielce, on the instruction of the Deputy Prosecutor from the Regional District Court Prosecutor’s Office in Kielce, dated 20 March 1948, no. 48/48, with the participation of court reporter Marian Poniewierka, interviewed the person named below as a witness. Having been advised of the criminal liability for making false declarations and of the wording of Article 140 of the Penal Code, the witness testified as follows:

In 1944, in my presence, the German Gestapo arrested Józef Niedziela and took him to the prison in Kielce. Before Józef Niedziela was arrested, Chmiel visited me twice and inquired about the behavior of Józef Niedziela, asking whether it was good. I told Józef Niedziela that Chmiel took interest in his behavior and that I found it suspicious, but Niedziela replied that he was not afraid at all. Three weeks later, four Gestapo men and one civilian man came and arrested Józef Niedziela. He spent about four months in the prison in Kielce.

Towards the end of November 1944, I learned from other people that Józef Niedziela was executed at Prosta Street in Kielce together with four other Poles and that they were buried at the execution site.

After the liberation, the bodies of Józef Niedziela and the four Poles (I don’t know their surnames) were transferred to the cemetery of the former resistance fighters in Kielce.

I don’t know who carried out the execution and whether it was carried out in retaliation.

At this point, the report was concluded and read out before signing.
