ZYGMUNT JACKOWICZ

On 11 May 1946, the Municipal Court in Opatów, represented by Judge Al. Zalewski, with the participation of reporter R. Cybulski, interviewed the person mentioned below as a witness. Having advised the witness of the criminal liability for making false declarations, of the wording of Article 107 of the Code of Criminal Procedure, and of the significance of the oath, the judge swore the witness in accordance with Article 108 of the Code of Criminal Procedure, whereupon the witness testified as follows:

During the German occupation, I was a policeman at the police station in Łagów. On 16 March 1942 or 1943, the German gendarmerie arrived. By the lieutenant’s order, together with Wiktor Berger and some other gendarme, I went to the apartment of Dr. Pokrzywa. He was ordered to get dressed, then he was brought to the police station office, where the head of the expedition was waiting for us. As he was walking past him, Dr. Pokrzywa took a look at the papers lying [on the table]. Seeing that, the lieutenant yelled at him and ordered Berger to take him outside. After a while, a shot was fired, then Berger returned and filed a short report, and the lieutenant made some kind of mark in the files. Soon afterwards, when we left the station, Dr. Pokrzywa was lying dead in the yard. We were all certain that no one other than him [Berger] could do it, as it happened right after he had taken Dr. Pokrzywa outside.
